TERMS AND CONDITIONS OF THE ONLINE STORE Superb Health & Beauty Ltd

    1. Definitions

      The terms used in the Regulations mean:

      1. Customer - a natural person, a legal person or an organisational unit which is not a legal person, the special provisions of which grant legal capacity, which places Orders within the Store;
      2. Consumer - A customer who is a natural person. According to this definition, a consumer is a natural person who performs with the entrepreneur a legal act not related directly to his business or professional activity.
      3. Regulations - these Regulations for the provision of electronic services as part of the online store Superb Health & Beauty Ltd;
      4. Online Store (Store) - an online service available under superbhb.co.uk, through which the Customer may in particular place Orders;
      5. Goods - products presented in the Online Store;
      6. Order - Customer's declaration of intent, aimed directly at the conclusion of the Sales Agreement, specifying in particular the type and number of Goods.
    2. General decisions
      1. These Regulations set out the rules for using the online store available at: superbhb.co.uk
      2. The online store operating at: superbhb.co.uk is run by Superb Health & Beauty Ltd.
      3. These Regulations specify in particular:
        1. rules for registering and using an account as part of an online store;
        2. terms and conditions for electronic booking of products available as part of the online store;
        3. terms and conditions for electronic submission of Orders as part of an online store;
        4. rules for concluding Sales Agreements using services provided as part of the online store.
      4. Using the online store is possible provided that the ICT system used by the Customer meets the following minimum technical requirements:
        1. Internet Explorer version 10 or later with JavaScript enabled, or
        2. Chrome version 49 or newer with JavaScript enabled, or
        3. Firefox version 43 or newer with JavaScript enabled, or
        4. Microsoft Edge version 13 or later with JavaScript enabled, or
        5. Opera version 36 or newer with JavaScript enabled, or
        6. Safari version 4 or newer with JavaScript enabled.
      5. In accordance with applicable law, Superb Health & Beauty Ltd reserves the right to limit the provision of services via the Online Store to persons who are at least 18 years old. In this case, potential customers will be notified of the above.
      6. Customers can access these Regulations at any time via the link on the home page of superbhb.co.uk and save its content and make a printout.
    3. Rules for using the Online Store
      1. In order to ensure the security of the transmission of messages and data in connection with the services provided as part of the Website, the Online Store takes technical and organisational measures appropriate to the degree of threat to the security of the services provided, in particular measures to prevent unauthorised persons from obtaining and modifying personal data sent on the Internet.
      2. The customer is obliged to:
        1. not to provide or transfer content prohibited by law, e.g. content that promotes violence, defamatory or violates personal rights and other rights of third parties,
        2. using the online store in a way that does not interfere with its operation, in particular through the use of specific software or devices,
        3. use the online store in a manner consistent with the provisions of the law in force in the United Kingdom, the provisions of the Regulations, as well as with the general principles of using the Internet.
    4. The procedure of concluding a Sales Agreement
      1. Information about the Goods provided on the Store's websites, in particular their descriptions, technical and functional parameters as well as prices, constitute an invitation to conclude a contract.
      2. In order to conclude the Sales Agreement via the Online Store, go to the superbhb.co.uk website, make your choice, taking further technical steps based on the messages displayed to the Customer and information available on the website.
      3. The choice of Goods ordered by the Customer is made by adding them to the basket.
      4. When placing the Order - until you click the "I am ordering with payment obligation" button or another message indicating the obligation to pay "I am ordering and paying" - the Customer can modify the entered data and the selected Good. For this purpose, follow the displayed messages and information available on the website.
      5. After the Customer using the online store has provided all necessary data, a summary of the order will be displayed. The order summary will contain information on:
        1. the subject of the order,
        2. unit and total price of ordered products or services, including delivery costs and additional costs (if any),
        3. the chosen payment method,
        4. the chosen method of delivery,
        5. delivery time.
      6. In order to send an Order, it is necessary to provide personal data marked as mandatory and to press the "I am ordering with payment obligation" button or other information indicating the obligation to pay "I am ordering and paying".
      7. Sending the Order by the Customer constitutes a declaration of will to conclude a Sales Agreement with Superb Health & Beauty Ltd, in accordance with the Regulations.
      8. After placing the Order, the Customer receives an email containing the final confirmation of all relevant elements of the Order.
      9. The contract is considered concluded when the Customer receives the e-mail message referred to above.
      10. The contract is concluded in Polish or English. Consolidation, protection and sharing of Order data and general conditions (Online Store Regulations) takes place via e-mail.
    5. Delivery
      1. The delivery of Goods is limited to the United Kingdom and takes place at the address provided by the Customer when placing the Order.
      2. Delivery of ordered Goods is done by Royal Mail courier. Delivery costs are shown on website. Delivery costs will also be indicated when placing the Order.
    6. Prices and payment methodsi
      1. Commodity prices are given in GBP and contain all components, including VAT.
      2. The customer has the option of paying the price:
        1. by transfer to the bank account,
        2. payment via PayPal,
        3. American Express, Delta Visa Debit, Diners Club, MasterCard, Mastercard Electronic, MasterCard Mobile, Visa, Visa Electron payment cards.
  1. The right to withdraw from the contract
    1. The customer who is a consumer is entitled to a 14 day withdrawal period. The consumer has the right to withdraw from this contract within 14 days without giving any reason. The deadline to withdraw from the contract expires after 14 days from the day on which you came into possession of the item or on which a third party other than the carrier and indicated by you came into possession of the item.
    2. To exercise your right of withdrawal, you must inform us of your decision to withdraw from this contract by an unequivocal statement (for example, a letter sent by post, fax or e-mail).
    3. You can use the model withdrawal form, but it is not mandatory.
    4. To meet the deadline to withdraw from the contract, it is enough for you to send information regarding the exercise of your right to withdraw from the contract before the deadline for withdrawing from the contract.
  2. Effects of withdrawal from the contract
      1. In the event of withdrawal from this contract, we will refund all payments received from you, including the costs of delivery (except for additional costs arising from your chosen delivery method other than the cheapest usual delivery method offered by us), immediately, and in any case not later than 14 days from the day on which we were informed about your decision to exercise the right to withdraw from this contract. The refund of payments will be made using the same payment methods that you used in the original transaction, unless you have expressly agreed otherwise; in any case, you will not incur any fees in connection with this refund.

     

  3. We may withhold reimbursement until we receive the item or until we receive proof of sending it back, whichever occurs first.

     

  4. Please send or return the item to us immediately, and in any case no later than 14 days from the day on which you informed us of your withdrawal from this contract. The deadline is met if you send back the item before the 14-day deadline. You will have to bear the direct cost of returning the item. You are only responsible for reducing the value of things resulting from using it in a different way than was necessary to establish the nature, characteristics and functioning of the thing.

  5. Complaints about Goods
    1. Complaints arising from violation of rights guaranteed by law, or on the basis of these Regulations, should be addressed to office@superbhb.co.uk. The seller undertakes to consider each complaint within 14 days.
    2. The seller is not a producer of goods. The manufacturer is liable under the warranty of the sold Goods on the terms and for the period indicated in the warranty card]. If the warranty document provides for this possibility, the Customer may submit his claims under the warranty directly at the authorized service whose address is in the warranty card.
  6. Complaints regarding the provision of electronic services
    1. The online store undertakes actions to ensure the fully correct operation of the website and store websites, to the extent that results from current technical knowledge and undertakes to remove within a reasonable time any technical irregularities reported by customers.
    2. Irregularities related to the functioning of the website and the store's websites may be reported by the Customer in writing to 112 High Street, TW3 1NA, London, United Kingdom, by email at office@superbhb.co.uk.
    3. In the complaint, the Customer should describe the type and date of occurrence of irregularities related to the functioning of the Store.
  7. Dispute resolution and final provisions
    1. The customer who is a consumer may, if interested, use extrajudicial means of dealing with complaints and redress. Disputes regarding online purchases can be resolved through mediation proceedings before the Provincial Inspectorates of the Trade Inspection or a trial before the arbitration court at the Provincial Inspectorate of the Trade Inspection. The consumer may also use other methods of out-of-court dispute resolution and e.g. lodge his complaint via the EU ODR online platform, available at: http://ec.europa.eu/consumers/odr/
    2. In matters not covered in these Regulations, the provisions of the Civil Code, the provisions of the Act on the provision of electronic services and other relevant provisions of law shall apply.
